Methods: In this study, in order to answer the research questions, it were described and analyzed based on the jurisprudents of Imamiya jurisprudence and internal rules and regulations. Findings: Individuals dominate their property; so according to the narrative of 'it is not permissible for a Muslim to have money except for oneself', domination and capture of the person's property without their satisfaction is forbidden. Conclusions: The challenging phenomenon of receive informal payment with any motivation will be accompanied by the spread of injustice and disorder in human society that is not in accordance with the Justice-centered system of Islam. Therefore, the right of claim for material and spiritual damages for patient or the patient's parents will be provided as rule of 'any money has void'. Because each medical achievement creates its issues, in which the law must also provide legal solutions to the newly created problems. Therefore, integrating the science of law with the medical sciences is necessary and inevitable. Tort law, as one of the legal strategy for dealing with medical negligence and malpractice, provided the rights for patients. The aim of the present study was to investigate the position of medical negligence in the light of tort rights.  Conclusion: In order to recognize a physician as responsible for medical negligence, it is necessary to prove three elements. First, a physician must have a legal obligation to patient care. Secondly, a physician must violate the legal obligation of care of the patient and the last element is the causal relationship between the violation of an obligation by a physician and the injury to the patient. The important matter about these elements is that the patient has to prove all three elements, otherwise, the physician will not be responsible for the negligence. Therefore, if the physician has performed the patient's treatment process in accordance with the medical principles and required skills and the patient is unable to prove the negligence of the physician, then the physician will not be responsible for the negligence and harm to the patient may be due to the patient's fault and negligence. The scholars' view of the verses of the Holy Quran, which is a modern scientific-professional interpretation, should be cautious. The purpose of this study was to evaluate the views of Shiite and Sunni commentators on determining the exact number of physical health verses in the Holy Qur'an and examining the various concepts of health in the Holy Quran. Information & Methods: This review study is applied in terms of purpose and descriptive-analytical in terms of method that was carried out by library and citation study method. By examining the texts of the Holy Qur'anic interpretations, various themes and concepts of health underlying the Qur'an were extracted and compared in six selected Shiite and Sunni interpretations. Findings: Combined topics of health branches in this research were the topic of healing, embryology, senses, nutrition, breastfeeding, fasting and sexual health that the verses of the Holy Quran directly refer to them. The commentators' explanations in each of the themes of the verses of health were scientific and consistent with the purpose of the verses. Based on this, the purpose of the present study was to explain the maternal criterion in children born of reproductive methods such as human simulation and donation of oocytes, embryo donation and uterine donation. In collecting the data and information, the documentary and library methods were used and analysis of the information obtained from the sources of narrative, Quranic and jurisprudential texts, qualitatively and based on the inference of the researchers was done. Conclusion: By reflecting on the Quranic verses related to maternal criterion and the word of jurisprudents, especially contemporary Shi'a jurisprudents, it is clear that the mother's criterion in man through simulation is different from other new fertility methods, and the mother of the child born from the simulation is the mother of stem cell owner.
